Privacy Policy

Forex Sport Pty Ltd (ACN 147 363 175, AFSL 401379) is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, hold, use and disclose your personal information, and how you can access, correct or complain about the handling of that information.

  1. Our commitment

    We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, as defined in the Privacy Act. We collect personal information only as necessary to provide our services and to meet our regulatory obligations, and we do not sell or trade your personal information to third parties.

  2. Information we collect

    The personal information we collect may include:

    • identity and contact details, such as your name, address, date of birth, email and telephone number
    • government-issued identification and proof of address collected to verify your identity
    • financial and transaction information, including bank account and beneficiary details and your transaction history
    • account credentials and records of your interactions with our online client portal
    • records of communications with us, including recorded telephone calls
  3. Identity verification (AML/CTF)

    As a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we are required to collect and verify your identity before providing designated services and to identify beneficial owners of legal entities. You must provide government-issued identity documents and proof of address.

    We may also verify your information electronically against public and private databases, including those maintained by the Australian Passport Office, Medicare Australia, the Australian Taxation Office, VicRoads, and state transport and road authorities. We cannot open an account if identity verification is unsuccessful.

    We are required to report suspicious matters, threshold transactions (over AUD $10,000 cash) and international funds transfer instructions to AUSTRAC. We are prohibited by law from disclosing to you whether a suspicious matter report has been submitted in respect of your account.

  4. How and why we use your information

    We use your personal information for:

    • account administration and transaction processing
    • compliance with applicable legislation and our regulatory obligations
    • marketing, where you have consented (you may opt out at any time)
    • improving our services
  5. Who we disclose information to

    We may share your personal information with:

    • our service providers and technology partners
    • introducing brokers and referrers
    • government and regulatory bodies, including ASIC, AUSTRAC and the ATO, as required by law
    • correspondent and beneficiary banks, for the purpose of international transfers
    • law enforcement agencies upon a valid court order

    Some of these recipients — in particular correspondent and beneficiary banks — may be located overseas, and disclosure to them may be necessary to complete your international transfer.

  6. Storage and security

    We take reasonable steps to ensure your personal information is accurate, complete, up to date and stored securely, and to protect it against unauthorised access, modification or disclosure. Our safeguards include multi-factor authentication for online access, encryption of data in transit, and the segregation of client funds from our operating funds. We retain transaction records and recorded calls for a minimum of seven years, consistent with the Corporations Act 2001 (Cth).

  7. Access and correction

    You have the right to request access to, and correction of, the personal information we hold about you. To make a request, contact our Privacy Officer using the details below. We will respond within a reasonable period and in accordance with the Privacy Act.

  8. Data breaches

    In the event of an eligible data breach, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth).

  9. Privacy complaints

    If you have a concern about how we have handled your personal information, please contact our Privacy Officer in the first instance and we will endeavour to resolve it. If you are not satisfied with our response, you have the right to escalate the matter to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

  10. Changes to this policy

    We may update this Privacy Policy from time to time by posting the updated version on this website. The version published here is the current version and applies from the date shown above.
